For a mutual divorce: Section 13B of the Hindu Marriage Act, 1955 deals with the provision for mutual divorce by husband and wife. When both parties agree to the divorce, the minimum required period of separation is one year for getting divorce. It provides for the dissolution of a marriage by a decree of divorce on the ground that the parties have been living separately for a continuous period of not less than one year, and have mutually agreed to dissolve the marriage.
Where both the parties agree to end their marriage amicably. They have to jointly file a petition for mutually getting divorce, with their decision to separate and if the Court is satisfied then divorce can be granted by the Court.
For a contested divorce: there is no minimum required period of separation , if you alone want to get divorce then you can file a petition after 1 year of your marriage.
